What remains uncertain

The joint venture has not closed; closing depends on a Briscoe County tax abatement vote expected around Nov. 9, 2026, final ancillary agreements and ChronoScale's internal approval of a data center lease, with an outside date of Dec. 1, 2026 (extendable to no later than Dec. 31, 2026).
ChronoScale has signed only a non-binding letter of intent to lease the facility; no definitive lease, tenant or end user is confirmed. An EPC contract with Hypergate is to be signed at or before closing.
The 8-K says some development work has begun at the site at Applied Digital's cost, but no construction start, energization date or total project cost is stated. The split between wind and grid power is not stated.
The 50 MW critical IT and approximately 75 MW gross figures describe the same phase and are not additive. Dorothy 3's stated potential of up to 300 MW is for the whole parcel and is not recorded as this phase's figure.
